PERSONAL SAFETY INTERVENTION ORDERS ACT 2010 - SECT 123

Restriction on publication of proceeding in Magistrates' Court

    (1)     This section applies to—

        (a)     a proceeding under this Act, other than in the Children's Court; or

S. 123(1)(b) amended by No. 42/2014 s. 134(a).

        (b)     an order made under this Act, other than by the Children's Court;

S. 123(1)(c) inserted by No. 42/2014 s. 134(b).

        (c)     a litigation restraint order proceeding in the Magistrates' Court; or

S. 123(1)(d) inserted by No. 42/2014 s. 134(b).

        (d)     an order made by the Magistrates' Court under the Vexatious Proceedings Act 2014 that relates to an application or a proceeding under this Act.

Note

For a proceeding in the Children's Court, see section 534 of the Children, Youth and Families Act 2005 which provides restrictions on the publication of proceedings in that Court.

    (2)     A person must not publish, or cause to be published, a report of the proceeding or about the order that contains—

S. 123(2)(a) amended by No. 77/2014 s. 25(1).

        (a)     if a party to or a witness in the proceeding, or a person the subject of the order, is a child—

              (i)     the locality or any particulars likely to lead to the identification of the particular venue of the court; or

S. 123(2)(a)(ii) amended by No. 77/2014 s. 25(1).

              (ii)     any particulars likely to lead to the identification of the child or any other person involved in the proceeding, either as a party to the proceeding or as a witness in the proceeding, or the subject of the order—

unless the court orders under section 125A that the locality or particulars may be published; or

        (b)     a picture of or including a child concerned in a proceeding for a personal safety intervention order, unless the court orders under section 125A that the picture may be published.

Penalty:     In the case of a natural person—100 penalty units or 2 years imprisonment or both;

In the case of a body corporate—500 penalty units.
