Procedure on review

68C. Procedure on review





(1) In conducting a review under this Division, the Appeals Board must proceed
as follows-

   (a)  first, it must consider the Chief Commissioner's reasons for the
        decision to dismiss the applicant from the force;

   (b)  secondly, it must consider the case presented by the applicant as to
        why the decision was not sound, defensible or well-founded;

   (c)  thirdly, it must consider the case presented by the Chief Commissioner
        in answer to the applicant's case.

(3) The applicant has at all times the burden of establishing that the
decision to dismiss the applicant from the force was not sound, defensible or
well-founded.
