49. Power to reduce pension etc. where infirmity is due to misconduct

Where a member of the force retires on account of infirmity of mind or body
and the ESS Board is satisfied on a medical certificate that he has brought
about or contributed to the infirmity by his own default or his vicious habits
the Governor in Council may in his discretion reduce the amount of his pension
or gratuity by an amount not exceeding one-half of that to which he would be
otherwise entitled.
