Acting Director
9. Acting Director
(1) The Governor in Council may appoint a person who is eligible for
appointment as the Director to act as the Director during any period when-
(a) the office of Director is vacant; or
(b) the Director is absent from duty or is, for any reason, unable to
carry out the duties of the office.
(2) The Governor in Council may at any time terminate the appointment of the
Acting Director.
(3) The Acting Director has, during the period of the appointment, the same
powers and duties as the Director and may perform any of the functions of the
Director.
(4) The Acting Director is entitled to the remuneration and allowances (if
any) fixed in respect of him or her by the Governor in Council.
(5) The office of Acting Director is not an authority within the meaning of
section 104(1) of the Public Administration Act 2004.
