Magistrates' Court may extend retention period
24ZK. Magistrates' Court may extend retention period
(1) Subject to subsection (2), an inspector may apply to the Magistrates'
Court within 60 days after seizing a thing under this Part, or within any
period extended by the Court under this section, for an extension of the
period during which the inspector may retain the thing.
(2) The Court may order an extension if it is satisfied that retention of the
thing is necessary for the purposes of the investigation in relation to which
the thing was seized.
(3) The Court may adjourn an application to enable notice of the application
to be given to any person.
(4) In ordering an extension the Court must ensure that the period during
which a thing may be retained by an inspector does not exceed 12 months after
the day that it was seized.
