Cancellation of a rodeo licence, a rodeo permit or rodeo school permit

17I. Cancellation of a rodeo licence, a rodeo permit or rodeo school permit



(1) If, after considering any submissions made within the time fixed for
making submissions under section 17G(2)(c), the Department Head is satisfied
that-

   (a)  the licence or permit holder has failed to comply with a condition of
        the licence or permit; or

   (b)  the licence or permit holder has been found guilty of an offence
        against this Act or regulations under this Act; or

   (c)  that the licence or permit holder has been served with an infringement
        notice in respect of an offence against this Act or regulations under
        this Act-

   (i)  that has not been withdrawn in accordance with the
        Infringements Act 2006; and

   (ii) in respect of which the licence or permit holder has paid the penalty
        in accordance with the Infringements Act 2006- the Department Head
        may-

   (d)  cancel the licence or permit; or

   (e)  require the licence holder or permit holder to take the action
        specified by the Department Head.

(2) The Department Head must give notice to the licence holder or permit
holder of his or her decision under subsection (1) and set out reasons for
that decision in the notice.

(3) A notice under subsection (2) must be served on the licence holder or
permit holder within 28 days after the expiry of the date for the making of
submissions under section 17G(2)(c).

(4) Cancellation of a rodeo licence, a rodeo permit or rodeo school permit by
the Department Head has effect from the date on which notice of the
cancellation is served on the holder of the licence or permit.
