24. Application fee etc.



(1) An application under section 23 shall be accompanied by-

   (a)  the prescribed fee; and





   (b)  a deposit of 10% of the amount specified in the application under
        section 23(4)(d) or a bank guarantee for the amount of that deposit.

(2) Subject to subsection (3), if a permit is not granted on the application-

   (a)  the amount of the deposit must be refunded to the applicant; or

   (b)  the bank guarantee is discharged.

(3) Where an applicant on whom there has been served an instrument under
section 25 does not request the Minister in accordance with section 26 to
grant the permit referred to in the instrument, the deposit shall not be
refunded to the applicant.
