46E. Rule against self-incrimination does not apply



(1) A licensee is not excused from answering a question or providing
information under section 46D on the ground that the answer or the information
might tend to incriminate the licensee.

(2) Before a licensee is required by the Authority to answer a question, the
Authority must inform the licensee that if they claim, before answering the
question, that the answer might tend to incriminate them, the answer is not
admissible in evidence in any criminal proceedings, other than in proceedings
in respect of the falsity of the answer.

(3) If the licensee claims, before answering a question, that the answer might
tend to incriminate the licensee, the answer is not admissible in evidence in
any criminal proceedings, other than in proceedings in respect of the falsity
of the answer.
