PRIVACY AND DATA PROTECTION ACT 2014 - SECT 74
Who are the parties to a proceeding?(1) The complainant and the respondent are parties to a proceeding in respect of a complaint referred to in section 73(1).

(2) The Information Commissioner is not a party to a proceeding in respect of a complaint referred to in section 73(1)(a) unless joined by VCAT.
