PRIVACY AND DATA PROTECTION ACT 2014 - SECT 31

Information Commissioner may make public interest determination

    (1)     The Information Commissioner may make a public interest determination on application under section 29 if satisfied that the public interest in the organisation doing the act or engaging in the practice substantially outweighs the public interest in complying with the specified Information Privacy Principle or approved code of practice.

    (2)     In deciding whether to make a public interest determination, the Information Commissioner must have regard to—

        (a)     whether not permitting the organisation to do the act or engage in the practice would be in the public interest; and

        (b)     the objects of this Act; and

        (c)     any submissions received under section 29; and

        (d)     any matters raised before the Information Commissioner in a conference under section 29.

    (3)     A public interest determination must include a statement of reasons for making the determination.

    (4)     A public interest determination must be published on the Internet site of the Information Commissioner.
