Public entity or Minister may bring proceedings

87. Public entity or Minister may bring proceedings

If a director of a public entity contravenes this Division in relation to the
public entity, the public entity or the Minister responsible for the public
entity, in the name of the public entity, may recover from the director as a
debt due to the public entity by action in a court of competent jurisdiction
either or both of the following-

   (a)  if the director, or any other person, made a profit as a result of the
        contravention, an amount equal to that profit;

   (b)  if the public entity has suffered loss or damage as a result of the
        contravention, an amount equal to that loss or damage.
