Who are executives for the purposes of this Division?
23. Who are executives for the purposes of this Division?
(1) A person is an executive for the purposes of this Division if he or she-
(a) is employed as an executive under this Part; or
(b) holds a statutory office which is a declared authority; or
(c) holds a prerogative office which is a declared authority; or
(d) is employed by a declared authority and the Governor in Council, by
Order published in the Government Gazette, has declared that
employment to be employment as an executive.
(2) An Order under subsection (1)(d) must specify the person or body that is
to be the employer of the executive for the purposes of this Division.
(3) The Governor in Council may, by Order published in the Government Gazette,
revoke or amend any declaration under subsection (1)(d).
(4) If a person ceases to be an executive because of an Order made under
subsection (3), the person's employment by the declared authority is not
thereby terminated.
(5) An Order made under subsection (1)(d) or (3) may contain provisions of a
savings or transitional nature consequent on a person becoming or ceasing to
be an executive.
