79G. Actions commenced by Commissioner for Corporate Affairs



(1) Any act, matter or thing of a continuing nature commenced under this Act
or regulations made under this Act, by or against or in relation to the
Commissioner for Corporate Affairs and existing immediately before the
commencement of section 89 of the Fair Trading (Amendment) Act 2003, may be
continued and completed on and after that commencement by or against or in
relation to the Director of Consumer Affairs Victoria.

(2) If, immediately before the commencement of section 89 of the Fair Trading
(Amendment) Act 2003, proceedings under this Act to which the Commissioner for
Corporate Affairs was a party were pending or existing in any court or
tribunal, then, on and after that commencement, the Director of Consumer
Affairs Victoria is substituted for the Commissioner for Corporate Affairs as
a party to the proceedings and has the same rights and obligations in the
proceedings as had the Commissioner for Corporate Affairs.
