Outworkers (Improved Protection) Act 2003 - SECT 4

Outworkers are employees for the purposes of certain laws

4. Outworkers are employees for the purposes of certain laws



(1) For the purposes of the laws specified in subsection (2)-

   (a)  an outworker is an employee;

   (b)  a person who engages an outworker is an employer;

   (c)  the contract between an outworker and a person who engages him or her
        is a contract of employment;

   (d)  the conditions on or under which an outworker performs work are
        conditions of employment;

   (e)  the relationship between an outworker and a person who engages him or
        her is an employment relationship.

(2) The laws referred to in subsection (1) are-

   (a)  this Act;

   (c)  the Long Service Leave Act 1992;

   (d)  the Occupational Health and Safety Act 2004;



   (e)  the Public Holidays Act 1993;

   (f)  regulations and other subordinate instruments made under an Act
        specified in paragraph (a), (c), (d) or (e).
