Loss or damage caused by authorised representative

92. Loss or damage caused by authorised representative



(1) If an authorised representative of a registered employee organisation is
convicted or found guilty of an offence against section 91, a person who
suffers significant loss or damage as a result of the commission of the
offence is entitled to recover from that organisation, by action in a court of
competent jurisdiction, an amount in respect of that loss or damage.

(2) A court may make an order in proceedings under subsection (1) for the
payment of an amount that the court considers reasonable in the circumstances.
