Power to obtain information
9. Power to obtain information
(1) For the purpose of ascertaining whether this Act or the regulations have
been complied with or of investigating a suspected contravention, the
Authority may (by written notice) require a person to-
(a) give the Authority such information as the Authority requires; or
(b) produce a document in the custody or control of the person.
(2) A person must not, without reasonable excuse, refuse or fail to comply
with a requirement under subsection (1).
Penalty: 60 penalty units for a natural person; 300 penalty units for a body
corporate.
(3) A notice under subsection (1) directed to a natural person must inform the
person that he or she may refuse or fail to give any information if giving the
information would tend to incriminate him or her.
Note Under section 153, it is an offence for a person to give information in
complying or purportedly complying with this Act that the person knows to be
false or misleading in a material particular.
