Obligation to persons assisting health and safety representatives

70. Obligation to persons assisting health and safety representatives



(1) An employer, any of whose employees are members of a designated work group
must allow a person assisting a health and safety representative access to the
workplace unless the employer considers that the person is not a suitable
person to assist the representative because of insufficient knowledge of
occupational health and safety.

(2) If an employer does not allow a person assisting a health and safety
representative access to the workplace, the representative may apply to the
Magistrates' Court for an order-



   (a)  directing the employer to allow that access; and

   (b)  specifying the terms and conditions of that access.
