33. Single charge for multiple contraventions of certain duties



(1) This section applies to-

   (a)  a contravention of a provision of Division 2, 3, 4 or 5 by a person;
        and

   (b)  a contravention of such a provision for which an officer of a body
        corporate, partnership or unincorporated body or association
        (including a body corporate, partnership or unincorporated body or
        association representing the Crown) is liable.

Note For liability of officers, see Divisions 4 and 5 of Part 11.

(2) Subject to any contrary court order, two or more contraventions may be
charged as a single offence if they arise out of the same factual
circumstances.

(3) This section does not authorise contraventions of two or more provisions
of Division 2, 3, 4 or 5 to be charged as a single offence.

(4) If two or more contraventions are charged as a single offence, a single
penalty only may be imposed in respect of the contraventions.
