Voting under power of attorney

88. Voting under power of attorney



(1) A person acting under a power of attorney may vote on the lot owner's
behalf at a general meeting or in a ballot of the owners corporation if this
is authorised by the power of attorney.

(2) A person is not entitled to exercise, under a power of attorney, the power
of a lot owner to vote if the person has that power in respect of another lot
owner under another power of attorney.

(3) Subsection (2) does not apply if the lot owners for whom the person is to
exercise a vote are members of that person's family.

(4) A person acting under a power of attorney for a lot owner may authorise a
person to act as a proxy under section 87.

(5) If a person is authorised under a power of attorney to vote on behalf of a
lot owner, this Part applies in relation to that power as if the holder of the
power of attorney were the lot owner.
