Application to Supreme Court

27. Application to Supreme Court



(1) Where in the course of an investigation under this Act the question arises
as to whether the Ombudsman has jurisdiction to conduct the investigation, the
Ombudsman or the party subject to the investigation, may make an application
to the Supreme Court for a determination of that question, and on the
application the Court may make such order as it considers proper.

(3) For the purposes of this section the principal officer of the authority
affected by the investigation shall be deemed to be a party subject to the
investigation.
