Permits to take fish or fishing bait for research in marine national parks and marine sanctuaries

21A. Permits to take fish or fishing bait for research in marine national
parks and marine sanctuaries



(1) The Secretary may, in respect of a marine national park or a marine
sanctuary, grant a permit to a person to take fish or fishing bait for the
purpose of any research, study or investigation that the Secretary considers-

   (a)  is appropriate; and

   (b)  does not detrimentally affect the area as a marine national park or
        marine sanctuary.

(2) A permit under subsection (1) is subject to the terms and conditions
determined by the Secretary.

(3) The holder of a permit must comply with the terms and conditions of the
permit.

Penalty: 20 penalty units.

(4) A person who acts under and in accordance with a permit under this section
does not commit an offence under the Fisheries Act 1995.
