Offence to engage in conduct that suggests sponsorship, approval or affiliation

37. Offence to engage in conduct that suggests sponsorship, approval or
affiliation



(1) A person must not engage in conduct which would suggest to a reasonable
person that goods or services have a sponsorship, approval or affiliation that
they do not have with-

   (a)  an event to which this Division of this Part applies; or

   (b)  the event organiser of an event to which this Division of this Part
        applies; or

   (c)  any event or activity associated with an event to which this Division
        of this Part applies.

Penalty: 100 penalty units, in the case of a natural person; 600 penalty
units, in the case of a body corporate.

(2) A person must not engage in conduct which would suggest to a reasonable
person that any person has a sponsorship, approval or affiliation that the
person does not have with-

   (a)  an event to which this Division of this Part applies; or

   (b)  the event organiser of an event to which this Division of this Part
        applies; or

   (c)  any event or activity associated with an event to which this Division
        of this Part applies.

Penalty: 100 penalty units, in the case of a natural person; 600 penalty
units, in the case of a body corporate.
