Security

38AD. Security



(1) The Department Head must, before granting an authority to enter land,
require a licensee to provide a security, of an amount and kind specified by
the Department Head, against the risk of damage to the property of the owner
or occupier of the land as a result of the licensee's entry on to, or
activities on, the land.

(2) The Department Head-

   (a)  may use the security, or part of it, to compensate the owner or
        occupier for any damage resulting from that entry or those activities;
        and

   (b)  must return the balance of the security to the licensee no later than
        30 days after the day on which the authority lapses or is withdrawn.
