26AC. Who may apply for a licence under this Subdivision?

A person may apply for a licence under this Subdivision only if the Minister
is satisfied that-

   (a)  the person was a successful tenderer under a prior competitive process
        equivalent to the tender process under section 27; and

   (b)  in order to implement the requirements of the tender, the person
        requires access to coal.
