Transfer of property in minerals

11. Transfer of property in minerals



(1) The property in minerals passes from the Crown to the holder of a licence
or a person searching under a miner's right or tourist fossicking authority
when the minerals are separated from the land in accordance with the licence,
miner's right or tourist fossicking authority.

(2) The property in minerals which are separated from the land otherwise than
in accordance with a licence, miner's right or tourist fossicking authority
remains in the Crown.

(3) Subsection (2) does not apply to minerals in respect of which a minerals
exemption is current.
