35. Leases etc. to be subject to certain terms



(1) Notwithstanding anything to the contrary in a lease, tenancy, permit or
licence of land forming part of, or of buildings or other chattels on, the
market land, the lease, tenancy permit or licence is subject to a condition
that the Authority may, by notice in writing given to the lessee, tenant,
permittee or licensee, terminate the lease, tenancy, permit or licence where
the lessee, tenant, permittee or licensee has contravened the provisions of
this Act, the by-laws or the terms or conditions of the lease, tenancy, permit
or licence or of the Farm Produce Wholesale Act 1990 or of regulations under
that Act insofar as they are applicable to him.

(2) Where the Authority gives a notice under subsection (1) in respect of a
lease, tenancy, permit or licence, the lease, tenancy, permit or licence is
terminated 14 days after the notice is given, unless within 7 days after the
notice is given, the lessee, tenant, permittee or licensee makes application
in writing to the Minister giving reasons why the lease, tenancy, permit or
licence should not be terminated and the Minister is of the opinion that, in
all the circumstances, it is reasonable to grant the request.

(3) The provisions of this section apply to and in respect of a lease,
tenancy, permit or licence whether granted before or after the appointed day.
