53A. Application of Divisions 3 and 4

In this Division and Division 3 (except in section 51)-





   (a)  a reference to the Secretary to the Department of Justice includes a
        reference to-

   (i)  the Secretary to the Department of Human Services in relation to a
        person detained in a remand centre, youth residential centre or youth
        justice centre within the meaning of the
        Children, Youth and Families Act 2005; and

   (ii) the Chief Commissioner of Police in relation to a person serving a
        sentence of imprisonment in a police gaol within the meaning of the
        Corrections Act 1986 or being held in police custody on the order of a
        court; and

   (b)  a reference to the Department of Justice includes a reference to-

   (i)  the Department of Human Services in relation to a person detained in a
        remand centre, youth residential centre or youth justice centre within
        the meaning of the Children, Youth and Families Act 2005; and

   (ii) the police force in relation to a person serving a sentence of
        imprisonment in a police gaol within the meaning of the
        Corrections Act 1986 or being held in police custody on the order of a
        court; and

   (c)  a reference to a prison or other place of confinement includes a
        reference to-

   (i)  a remand centre, youth residential centre or youth justice centre
        within the meaning of the Children, Youth and Families Act 2005; and

   (ii) a police gaol within the meaning of the Corrections Act 1986.
