Automatic discharge as a security patient at expiration of sentence

50. Automatic discharge as a security patient at expiration of sentence



(1) A person detained in an approved mental health service as a security
patient ceases to be a security patient immediately upon-

   (a)  the person being granted bail; or

   (b)  the person being released from custody by a court; or



   (c)  the expiry of the person's sentence of imprisonment or detention in a
        youth residential centre or youth justice centre; or





   (d)  the expiry of the person's hospital security order.



(2) The Secretary to the Department of Justice must notify the chief
psychiatrist when the sentence of imprisonment or detention in a youth
residential centre or youth justice centre of a patient is to expire.
