Regulation of height of buildings
64. Regulation of height of buildings
(1) In the interests of fire prevention the council of every city town or
borough the municipal district of which is wholly or partly within the
metropolitan district may pursuant to the provisions of any Act for the time
being in force relating to local government and with the approval of the
Governor in Council make alter or repeal by-laws for the purpose of regulating
or limiting the height of all buildings to be erected in such city town or
borough or in any part thereof specified in such by-law and for providing
means of escape from every such building in case of fire.
(2) Every person who constructs any building contrary to any such by-law and
suffers the height of the same to remain contrary to such by-law after
twenty-eight days' notice in writing from the council to reduce the height of
such building to the height limited in the by-law shall on conviction be
liable to a penalty of not more than 1/5 of a penalty unit for every day after
the expiration of such notice during which such building continues to be above
the height so limited.
