Motor Car Traders Act 1986 - SECT 61

Acting Chairperson

61. Acting Chairperson



(1) If-

   (a)  there is a vacancy in the office of Chairperson; or

   (b)  the Chairperson is or is about to be absent or for any reason is
        unable to perform the functions of the office-

the Governor in Council may appoint a person (not being a member of the
Committee) to act as the Chairperson until the filling of the vacancy or
during the absence or inability.

(2) The Governor in Council-

   (a)  may, subject to this Act, determine the terms and conditions of
        appointment of an acting chairperson of the Committee; and

   (b)  may at any time terminate such an appointment.

(3) The appointment of an acting chairperson of the Committee made in
anticipation of the absence or inability of the chairperson has effect from
and including the day on which the absence or inability commences.

(4) The appointment of an acting chairperson of the Committee ceases to have
effect if the acting chairperson resigns the appointment by writing signed by
the acting chairperson and delivered to the Governor.

(5) While the appointment of an acting chairperson of the Committee remains in
force, the acting chairperson has and may exercise all the powers and perform
all the functions of the Chairperson.
