Permission to continue to hold licence despite criminal act of partner or director

29C. Permission to continue to hold licence despite criminal act of partner or
director





(1) This section applies if a licensee is a partnership or a body corporate
and a partner or a director of the licensee is convicted or found guilty of a
serious offence (whether or not a conviction was recorded).

(2) The licensee may apply to the Authority for permission to continue to hold
its licence.

(2A) An application under this section must be in the form approved by the
Authority and contain any information and be accompanied by any documents
required by the Authority.

(2B) In considering an application under this section, the Authority may-

   (a)  conduct any inquiries it thinks fit;

   (b)  require the applicant to provide any further information that the
        Authority thinks fit in the manner required by the Authority;

   (c)  seek advice and information on the application from any other person
        or body as it thinks fit.

(2C) The Authority may refuse to consider the application if the applicant
does not provide the further information required, or his or her consent for
the Authority to obtain that information, within a reasonable time after the
requirement is made.

(3) The Authority may give its permission if it is satisfied that it is not
contrary to the public interest for it to do so.
