Determination of application

8. Determination of application

The Supreme Court may make a coercive powers order if satisfied-

   (a)  that there are reasonable grounds for the suspicion founding the
        application for the order; and

   (b)  that it is in the public interest to make the order, having regard to-

   (i)  the nature and gravity of the alleged organised crime offence in
        respect of which the order is sought; and

   (ii) the impact of the use of coercive powers on the rights of members of
        the community.
