Utility to obtain consent of Link corporation

47. Utility to obtain consent of Link corporation



(1) A Utility must obtain the written consent of the Link corporation before
carrying out or causing the carrying out of works on Utility infrastructure,
or for the construction of new Utility infrastructure, in, on, over or under
land in the Link Upgrade construction area.

(2) The Link corporation must not unreasonably delay or refuse its consent
under this section.

(3) A consent under this section may be granted on such reasonable conditions
as the Link corporation thinks fit.

(4) This section does not apply to Utility infrastructure if-

   (a)  an approved Utility agreement provides for access by the Utility to
        the Link Upgrade construction area to carry out works in relation to
        that Utility infrastructure; or

   (b)  the work is being carried out under a determination made under
        Subdivision 7.

(5) This section applies in addition to the requirements of and despite
anything to the contrary in any other Act or law.
