Return of property taken from a defendant

42. Return of property taken from a defendant

If-

   (a)  property has been taken from a defendant; and

   (b)  in the opinion of the Court the property or part of it can be returned
        consistently with the interests of justice and with the safe custody
        of the defendant-

the Court must direct that the property or part of it be returned to the
defendant or to such other person as the defendant directs.
