Regulations under this Part

55. Regulations under this Part



(1) The Governor in Council may make regulations for or with respect to any
matter or thing required or permitted by this Part to be prescribed or
necessary to be prescribed to give effect to this Part and, in particular,
except as otherwise provided in this Part, for or with respect to prescribing
penalties not exceeding-

   (a)  if the offender is a natural person-a fine of 20 penalty units or
        imprisonment for a period of 12 months, or both; or

   (b)  if the offender is a body corporate-a fine of 50 penalty units-

for a contravention of, or failure to comply with, a provision of the
regulations or a notice, order, direction or instruction given, issued or made
under, or in force by virtue of, the regulations.

(2) Regulations made under this Part may make provision for or with respect to
any matter by applying, adopting or incorporating, with or without
modification-



   (a)  the provisions of any Act of, or of any regulations made under an Act
        of, a State or the Commonwealth, as in force at a particular time or
        as in force from time to time; or

   (b)  any matter contained in any other instrument or writing as in force or
        existing at the time when the first-mentioned regulations take effect-

but the regulations shall not, except as provided by this subsection, make
provision for or with respect to a matter by applying, adopting or
incorporating any matter contained in an instrument or other writing as in
force or existing from time to time.

(3) In paragraph (a) of subsection (2), regulations includes orders made in
pursuance of regulations made under the Commonwealth Navigation Act to which
section 426 of that Act applies.
