401. Engine driver's permits etc1



(1) Subject to this section, the Chief Mining Inspector may grant a permit to
any person who has attained the age of 21 years authorizing him to take charge
of and drive, while men are being raised or lowered in or in connexion with a
mine, any winch, winding engine, hoist or crane.

(2) The Chief Mining Inspector shall not grant a permit under subsection (1)
in respect of a winding engine in or in connexion with a shaft having a depth
exceeding 10 metres unless an inspector has recommended that the permit be
granted.



(3) The Chief Mining Inspector on the recommendation of an inspector may
restrict in any manner, suspend or cancel a permit granted under subsection
(1).

(4) The Chief Mining Inspector shall not grant a permit in respect of-

   (a)  a winch;

   (b)  a winding engine;

   (c)  a hoist; or

   (d)  a crane-

where the mode of power is steam and which is used in or in connexion with a
mine of any depth, unless an inspector has recommended that the permit be
granted.

(5) Notwithstanding anything to the contrary in subsection (2) or subsection
(4) where the Chief Mining Inspector is satisfied that a person is in another
State or Territory of the Commonwealth or under a Commonwealth Act the holder
of a certificate of competency or a certificate of service or a permit
authorizing the person to take charge of and drive, where men are being raised
or lowered in or in connexion with a mine, any winch, winding engine, hoist or
crane he may, without obtaining the recommendation of an inspector, grant to
the person a permit under subsection (1).

(6) A permit under subsection (1) may be granted in respect of particular
machinery or any class or classes of machinery.

(7) There shall be paid in accordance with the regulations in respect of the
grant of a permit under subsection (1) such fees (if any) as may be
prescribed.
