Regulations
400E. Regulations
(1) The Governor in Council may make regulations for or with respect to the
qualifications of mine managers and the issue of certificates of competency or
permits under this subdivision.
(2) Without limiting the generality of subsection (1) the Governor in Council
may make regulations for or with respect to-
(a) the syllabuses fees chargeable including fees for the conduct of
examinations conducted under this subdivision and mode of examinations
conducted under this subdivision the qualifications to be possessed by
applicants for such examinations and generally anything necessary or
convenient to be prescribed in relation to examinations under this
subdivision;
(b) anything necessary or convenient to be prescribed in relation to the
alteration suspension cancellation revocation restoration or renewal
of certificates of competency granted by the Board or permits granted
under section 386;
(c) anything necessary or convenient to be prescribed in relation to
restrictions on certificates of competency or conditions or
restrictions to which permits granted under section 386 are subject;
(d) fees chargeable for the issue of certificates of competency granted by
the Board or permits granted under section 386;
(e) the annual value of scholarships not exceeding in any case $250;
(f) the conditions under which scholarships shall be held and under which
they may be forfeited;
(g) the qualifications and experience of persons who may be issued with
certificates of competency or permits under this subdivision;
(ga) prescribing classes of certificates of competency which the Board may
issue;
(gb) prescribing classes of mines in respect of which certificates of
competency may be issued;
(gc) prescribing classes of certificates of competency required to be held
by mine managers generally or any class thereof;
(gd) prescribing mines and classes of mines for the purposes of section
386;
(ge) prescribing the form of the register to be kept under section 386 and
the particulars to be contained in the register;
(gf) prescribing anything authorized or required to be prescribed or
necessary or convenient to be prescribed in relation to permits and
applications for permits under section 386, including (but without
limiting the generality of the foregoing) the forms of applications
and permits, and the fees which are to accompany applications; and
(h) prescribing penalties not in any case exceeding 5 penalty units for
any offence against the regulations made under this subdivision.
