387. Offence







(1) If a mine is at any time worked without there being a manager for the mine
as required by this subdivision the owner shall be liable to a penalty of not
more than 1 penalty unit for every day during which the mine is so worked.

(2) It shall be a defence to any proceedings under subsection (1) if the owner
proves that for any reasonable cause he is unable for the time being to obtain
a manager qualified as required by this subdivision.
