Liability for breach of regulations

380. Liability for breach of regulations

Every person who contravenes or fails to comply with any of the regulations
shall be guilty of an offence against this Act, and where there is in respect
of any mine any contravention of or non-compliance with any of the
regulations, then, without affecting the liability of any other person
therefor, the mining manager or person for the time being in charge of the
mine shall be guilty of an offence against this Act unless he proves that the
contravention or non-compliance occurred without his consent and that he had
taken all reasonable means to prevent such a contravention or non-compliance.
