Compensation

13O. Compensation



(1) Under section 23J of the Commonwealth Act, native title holders are
entitled to compensation for any extinguishment under this Part of their
native title rights and interests by an act, but only to the extent (if any)
that the native title rights and interests were not extinguished otherwise
than under this Act.

(2) The compensation is payable by the State.

(3) Compensation is to be determined in accordance with the principles
contained in Division 5 of Part 2 of the Commonwealth Act.
