Application to Tribunal
4.3.15. Application to Tribunal
(1) The following may apply to the Tribunal for resolution of a civil dispute
that is the subject of a civil complaint-
(a) a party to the dispute to whom the Commissioner gives notice under
section 4.3.6 or 4.3.7; or
(b) the complainant who has received a notice under section 4.3.13(2)(b).
(2) The application must be made within 60 days after the party received the
relevant notice from the Commissioner.
(3) The Tribunal cannot entertain an application by a complainant under this
section unless the complainant files with the Tribunal a written notice from
the Commissioner stating (as the case requires) that-
(a) the dispute is not likely to be resolved or is unsuitable for
resolution by the Commissioner; or
(b) the dispute could not be resolved by the Commissioner.
(4) The notice referred to in subsection (3) may be contained in the notice
referred to in subsection (1)(a) or (b).
