Prisoners must not practise
2.2.11. Prisoners must not practise
(1) An Australian lawyer who is a prisoner (within the meaning of the
Corrections Act 1986) must not, as an Australian lawyer, commence or continue
to act in any civil or criminal proceeding.
(2) A person who contravenes subsection (1)-
(a) commits a contempt of the Supreme Court; and
(b) is not entitled to recover any amount in respect of anything done
during the course of that contravention; and
(c) must repay any amount so received to the person from whom they were
received.
(3) If an Australian lawyer does not repay an amount required by subsection
(2)(c) to be repaid, the person entitled to be repaid may recover the amount
from the lawyer as a debt in a court of competent jurisdiction.
