Limitation of Actions Act 1958 - SECT 27A
Interpretation
27A. Interpretation
(1) In this Part-
guardian of a minor includes any person who is granted guardianship of the
minor under the Children, Youth and Families Act 2005 or any other Act or law;
long-stop limitation period, in relation to a cause of action for damages that
relate to death or personal injury, means the period of 12 years from the date
of the act or omission alleged to have resulted in the death or personal
injury with which the action is concerned; parent includes any person who has
all the duties, powers, responsibilities and authority (whether conferred by a
court or otherwise) which, by law, parents have in relation to children;
survivor action means a cause of action that survives for the benefit of the
estate of a deceased person under section 29(1) of the
Administration and Probate Act 1958 but does not include a cause of action to
which section 29(2A) of that Act applies.
(2) In this Part in relation to a cause of action under section 159 of the
Fair Trading Act 1999, a reference to a court includes a reference to the
Victorian Civil and Administrative Tribunal established by the
Victorian Civil and Administrative Tribunal Act 1998.
