Delegations
98. Delegations
(1) A Council may by instrument of delegation delegate to a member of its
staff any power, duty or function of a Council under this Act or any other Act
other than-
(a) this power of delegation; and
(b) the power to declare a rate or charge; and
(c) the power to borrow money; and
(d) the power to approve any expenditure not contained in a budget
approved by the Council; and
(e) any power, duty or function of the Council under section 223; and
(f) any prescribed power.
(2) The Chief Executive Officer may by instrument of delegation delegate to a
member of the Council staff any power, duty or function of his or her office
other than this power of delegation unless subsection (3) applies.
(3) The instrument of delegation to the Chief Executive Officer may empower
the Chief Executive Officer to delegate a power, duty or function of the
Council other than the power of delegation to a member of the Council staff.
(4) The Council must keep a register of delegations to members of Council
staff.
(5) A delegation under this section to a member of Council staff may be made
to-
(a) a person named in the delegation; or
(b) the holder of an office or position specified in the delegation.
(6) A Council must review within the period of 12 months after a general
election all delegations which are in force and have been made by the Council
under subsection (1).
