Resolution of disputes
9. Resolution of disputes
(1) Any difference or dispute arising between a Council and another public
body may be referred to the Governor in Council.
(2) The Governor in Council is to appoint a board of inquiry to inquire into
and determine any difference or dispute referred to the Governor in Council.
(3) For the purposes of any inquiry a board of inquiry has all the powers
conferred by sections 14 to 16 of the Evidence Act 1958.
(4) A determination of a board of inquiry is binding on the parties.
(5) If an Act contains a mechanism for resolving a dispute or difference in
respect of the performing of a function conferred on a Council by that Act,
that mechanism must be used instead of this section.
