Local Government Act 1989 - SECT 232

Proceedings

232. Proceedings



(1) The Secretary, a Council or a person authorised by the Council either
generally or in a particular case may institute proceedings in the corporate
name of the Council for-

   (a)  the recovery of any rates, charges, fees or other money due to the
        Council under any Act, regulation or local law; or

   (b)  the enforcement of any provision of any Act, regulation or local law
        for which the Council is responsible; or

   (c)  the recovery of any penalty or surcharge in relation to any offence
        under any Act, regulation or local law the enforcement of which is the
        responsibility of the Council; or

   (d)  any other purpose specified by the Council.

(2) A Chief Executive Officer or person authorised by the Council either
generally or in a particular case may represent the Council in all respects as
though he or she was the party concerned in any proceedings in which the
Council is a party or has an interest.

(3) Proceedings for a summary offence under this Act may be commenced within
the period of 3 years after the commission of the alleged offence.
