Amount of compensation
63. Amount of compensation
(1) The amount of compensation payable in respect of any premises, livestock
product, fodder, fitting or vehicle is the market value of the premises,
livestock product, fodder, fittings or vehicle at the time of destruction.
(2) The amount of compensation payable in respect of livestock that died or
was destroyed because of an exotic disease is-
(a) the market value of the livestock at the time at which the owner
consulted a veterinary practitioner about the diseased livestock or
notified an inspector of the disease under section 7 or restrictions
on the movement of the livestock were imposed under Part 3 or at the
time the Secretary was notified that it was affected by or died of the
disease, whichever is the earlier;
(b) with the approval of the Secretary, a further amount representing the
difference between the amount paid under paragraph (a) and the market
value at the time the restrictions on the movement of the livestock
under Part 3 ended if that value was greater than the amount paid
under paragraph (a).
