Enforcement of destruction order

38. Enforcement of destruction order



(1) A destruction order under section 36 may authorise an inspector to destroy
or cause the destruction of any premises or vehicle that is specified in the
order.

(2) The owner or person in charge of any premises or vehicle which is the
subject of a destruction order must, on request by an inspector, give any
assistance the inspector may reasonably require in carrying out the order.

(3) A person who fails or refuses to assist an inspector in accordance with
subsection (2) is only guilty of an offence if it is proved that, at the
material time, the person was informed by the inspector that failure or
refusal to comply with the request constituted an offence.
