Procuring transfer by fraud

117. Procuring transfer by fraud



(1) A person must not procure the transfer of a licence or BYO permit by fraud
or false representation.

Penalty: 50 penalty units.

(2) If a person is convicted of an offence under subsection (1), the Director,
the Chief Commissioner or a licensing inspector may apply to the Tribunal for
a declaration that the transfer is void.

(3) On an application under subsection (2), the Tribunal may-

   (a)  declare the transfer void; and

   (b)  if it does so, may make an order that the person convicted under
        subsection (1) be disqualified from holding a licence or BYO permit
        for a period not exceeding 3 years.

(4) The power of the Tribunal under this section is in addition to any of the
powers of the Tribunal under Part 6.
