Decontrol of premises comprising of business and private dwelling

48A. Decontrol of premises comprising of business and private dwelling

Notwithstanding anything in this Part prescribed premises constructed so that
a portion consists of business premises and the other portion a dwelling-house
shall, on such day (being a day not earlier than one year from the day on
which this section comes into operation) as the Governor in Council by Order
published in the Government Gazette may determine, cease to be prescribed
premises provided that-

   (a)  the premises are let for use and used as constructed both as business
        premises and as a dwelling-house; and

   (b)  the premises are not prescribed premises by virtue of an Order under
        subsection (1) of section 44 or subsection (1) of section 45 or either
        of the corresponding previous enactments.
